For over 70 years the Charter for the Kingdom of the Netherlands has constitutionally arranged the relationships between the Netherlands in Europe and its overseas territories. It provides a common legal framework grounded in a quest for prosperity, social justice and peace. At the same time, the Charter’s anniversary calls for a comparative reflection on its historical roots in colonialism and the unique cultural, geographical, and socio-economic contexts of each territory. Comparative law can help address questions that the overarching legal framework that the Charter continually raises in both the public and the private domain, on issues such as transformative justice, fundamental rights, and the general tension between unity and diversity. For this reason, the Netherlands Comparative Law Association organised its annual symposium of 2024 on this theme.
